Frequently Asked Questions

Common legal queries regarding Pakistani law procedures.

A Writ Petition is filed in the High Court under Article 199 of the Constitution of Pakistan when fundamental rights are violated, or when an administrative authority or government body acts without lawful authority. Common writs include Mandamus, Prohibition, Certiorari, Habeas Corpus, and Quo Warranto.

Property verification involves checking the registry documents (Sale Deed/Fard) in the Land Revenue Department (Patwari/Tehsildar database) or Land Record Authority (PLRA). It is crucial to verify that the seller is the registered owner, the property is free from encumbrances, and no stay order exists from any civil court.

Pre-arrest bail (Bail Before Arrest) is sought when a person fears arrest in a falsely registered criminal case, showing ulterior motives or malice by the complainant. Post-arrest bail is filed after the police arrest the accused, asserting that further inquiry is required and detention in jail is unjustified.

Company registration is handled by the Securities and Exchange Commission of Pakistan (SECP). The process involves obtaining name approval, preparing the Memorandum and Articles of Association, submitting form filings and paying incorporation fees online, and acquiring a Digital Signature and National Tax Number (NTN).
